General Terms and Conditions
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all business relationships between Wohnungsbot-Hamburg, owner Jasper Boeller, Witts Allee 1a, 22587 Hamburg (hereinafter referred to as the “Provider”) and the users of the Provider’s services (hereinafter referred to as the “Customer”) that are used via wohnungsbot-hamburg.de.
1.2 Deviating or additional terms of the Customer shall only become part of the contract if the Provider expressly agrees to their application.
2. Subject Matter of the Contract
2.1 The Provider makes available a paid service (“Wohnungsbot”) that continuously searches the websites of property portals for new apartment listings and sends the Customer corresponding notifications about new listings via the Telegram app.
2.2 The Customer has the option, provided it is available at the time the website is accessed, to use a time-limited trial phase.
2.3 The Provider assumes no warranty for the completeness or reliability of the notifications transmitted. It cannot be guaranteed that the Customer will receive every apartment listing or that wohnungsbot-hamburg.de captures every offer.
3. Conclusion of Contract
3.1 The contract for the use of the service becomes effective upon the Customer’s registration and the subsequent confirmation of payment and the acquisition of a permanent user licence by the Provider.
3.2 Registration takes place via the website and subsequently the Telegram bot, while payment is processed via the payment portal Stripe (stripe.com) or PayPal (paypal.com).
4. Payment Terms and Prices
4.1 The prices displayed on the website at the time of ordering are decisive.
4.2 The Customer receives access to the service immediately after payment.
4.3 The Provider reserves the right to adjust the price of the Wohnungsbot subject to prior notice.
5. Use and Availability of the Wohnungsbot
5.1 The Customer has the option to inquire about the status of his user licence via his account or by contacting support.
5.2 The Provider endeavours to provide the service continuously but cannot guarantee 100% availability. There is no right to compensation for periods during which the Wohnungsbot is unavailable.
6. Disclaimer of Liability
6.1 The Provider assumes no liability for the accuracy, completeness and timeliness of the information transmitted by the Wohnungsbot.
6.2 The Wohnungsbot as well as the website contain links to external third-party websites, over whose contents the Provider has no influence. The Provider can therefore assume no warranty for these external contents. The respective provider or operator of the linked pages is always responsible for their contents.
6.3 Should the Customer find misleading/incorrect information on the website or in the Wohnungsbot, he may contact the Provider. The Provider will review the manual removal or adjustment of the information.
7. Warranty & Guarantee
7.1 The Provider gives no warranty or guarantee for the availability and functionality of the service. In particular, there is no right to compensation for the period of limited functionality of the Wohnungsbot.
7.2 The Provider reserves the right to change, expand or completely discontinue the service at any time.
7.3 Should the Provider discontinue the operation of the Wohnungsbot, the Customer is not entitled to a refund of his acquired user licence, unless the user licence was acquired within 30 days before the discontinuation of the Wohnungsbot.
8. Right of Withdrawal
8.1 Consumers have the right to withdraw from this contract within fourteen days without giving any reason. As the Wohnungsbot constitutes digital goods pursuant to Section 356(5) of the German Civil Code (BGB), the price of the user licence will not be refunded.
8.2 The withdrawal period is fourteen days from the day on which the Customer took possession of the goods. To exercise the right of withdrawal, the Customer must inform Wohnungsbot-Hamburg, attn. Jasper Boeller, Witts Allee 1a, 22587 Hamburg, info@wohnungsbot-hamburg.de) by means of a clear statement (e.g. a letter sent by post, a fax or an email) of his decision to withdraw from this contract. It is sufficient for the Customer to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
8.3 The right of withdrawal is excluded for commercial customers.
9. Customer Support
9.1 The Provider offers support via email. However, 100% availability of support as well as a timely response are not guaranteed.
10. Data Protection
10.1 The Provider collects, processes and uses the Customer’s personal data exclusively in accordance with the statutory provisions.
10.2 Detailed information on data processing can be found in the Privacy Policy, which is available on the Provider’s website.
11. Copyright & Rights of Use
11.1 The Customer receives a simple, non-transferable right to use the information provided by the Wohnungsbot.
11.2 The information may only be used for the Customer’s personal needs and may not be passed on to third parties.
12. Amendments to the GTC
12.1 The Provider reserves the right to modify these GTC at any time. The Provider will inform the Customer in writing of the changes in good time.
12.2 The changes shall be deemed accepted unless the Customer objects within 14 days of receiving the notification of change.
13. Customer’s Obligations
13.1 The Customer is obliged to provide truthful information upon registration and to use the service exclusively within the framework of the statutory provisions and these GTC.
14. Contract Language
14.1 The contract language is German.
15. Place of Jurisdiction & Applicable Law
15.1 The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
15.2 The place of jurisdiction for all disputes arising from this contract is the Provider’s registered office, Hamburg.
